Terms of Service

1. Who you are contracting with

These Terms of Service ("Terms") are a binding agreement between you and ORCASOFT CONSULTANCY SERVICES (OPC) PRIVATE LIMITED, a one person company incorporated in India with its registered office at [Registered office address], Mumbai, Maharashtra, India, trading as Planimble ("Planimble", "we", "us", "our").

These Terms cover our website at planimble.com, the Planimble web application at app.planimble.com, and our application programming interfaces (together, the "Service"). When you use the Service, you contract directly with ORCASOFT CONSULTANCY SERVICES (OPC) PRIVATE LIMITED. Payments are handled by Paddle as described in section 5.

2. Acceptance and eligibility

You accept these Terms by creating an account, buying a subscription, or otherwise using the Service. Continuing to use the Service after we update these Terms means you accept the updated Terms.

You must be at least 18 years old and use the Service for professional or business purposes, for example as a property inspector, loss-control consultant, appraiser, QA reviewer or software partner. If you use the Service for an organization, you confirm that you are authorized to accept these Terms for it.

3. The Service

Planimble is a browser-based tool for sketching building footprints. It lets you:

• draw walls with keyboard (10-key) entry or a mouse, pen or touch;
• calculate gross living area (GLA), non-GLA area and perimeters by area class;
• place stamps such as doors, stairs, wood stoves, electrical panels and roof defects;
• run sketch checks and calculate an estimated replacement cost from the rates you enter;
• work offline on a signed-in device and sync to your account when online;
• export a print/PDF addendum, PNG images and JSON sketch data, and import or export area catalogs as JSON or XML.

We may improve, change or remove features over time. If we remove a feature that is central to a paid plan, you may cancel and ask for a refund of the current period.

4. Accounts and team roles

• Account required. You need an account to use the application. Email accounts must confirm their email address before the first sketch syncs. Google sign-in accounts are already confirmed.
• Security. Keep your sign-in details confidential. You are responsible for activity under your account. Tell us at once at support@planimble.com if you suspect misuse.
• Teams. Team workspaces have three roles. The owner manages billing, seats and people. Inspectors create, edit, sync and export sketches. QA reviewers review, edit and approve team sketches. The owner's organization controls the sketches created in its workspace.
• One person, one account. Free accounts are for one person each. We limit new sign-ups per network to prevent abuse.

5. Plans, payments and Merchant of Record

Prices are in US dollars. Applicable tax is added at checkout based on your location.

6. Renewal, failed payments, cancellation and refunds

• Renewal. Paid plans renew automatically at the end of each monthly or annual period until cancelled.
• Failed payments. If a renewal payment fails, your paid features stay on while Paddle retries the payment. If it still can't be collected, your account returns to the Free plan.
• Cancelling. Cancel at any time from Billing & invoices in the app, from the link in your Paddle receipt, or by emailing support@planimble.com. Cancellation takes effect at the end of the period you have paid for.
• After a paid plan ends. Your account returns to Free. Every existing sketch stays readable, editable and exportable; new sketches count toward the Free allowance.
• Refunds. You can ask for a refund within 30 days of any payment. See our Refund Policy.

7. Acceptable use

You agree not to, and not to let anyone else:

• use the Service for anything unlawful, fraudulent or deceptive;
• send spam or misuse team invitations, or open several Free accounts to get around the monthly limit;
• upload content you have no right to use, or infringe anyone's copyright, trademark, trade secret or privacy;
• copy, reverse-engineer or resell the Service or its code, except as the law allows;
• interfere with the Service's security: uploading malware, probing or scanning for vulnerabilities without our written permission, bypassing sign-in or rate limits, or using bots or scrapers against it.

8. Intellectual property and your content

Ours. We own the Service, including the software, geometry engine, design, documentation and the Planimble name and logo. We give you a limited, non-exclusive, non-transferable right to use the Service while your account is in good standing.

Yours. You (or your organization) own the sketches, measurements, addresses, policy numbers, notes and exports you create ("Your Content"). You give us permission to host, store, process and transmit Your Content only as needed to provide, secure and support the Service. We do not sell Your Content.

9. Availability, professional judgment and liability

• No uptime guarantee. We work to keep the Service available, and the app keeps working offline on a signed-in device, but we do not guarantee that the Service or syncing will be uninterrupted or error-free. Maintenance and security updates may briefly limit access.
• An aid, not an appraisal. Areas, sketch checks and replacement-cost figures are calculation aids based on what you enter. The replacement cost is an estimate, not an appraisal or valuation. You are responsible for checking measurements, rates and anything you submit for underwriting, claims or appraisal.
• As is. Apart from what these Terms promise, the Service is provided "as is" and "as available".
• Limit of liability. To the extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data. Our total liability for any claim relating to the Service is limited to the greater of the fees you paid us in the 12 months before the claim and US$50. Nothing here limits liability that cannot be limited by law.

10. Suspension and termination

By you. You can stop using the Service at any time and ask us to delete your account by emailing support@planimble.com.

By us. We may suspend or close an account, with notice where reasonable, for a serious or repeated breach of these Terms (including section 7), for non-payment, for fraud or a security risk, or where the law requires it. If we close your account without cause, we will refund any unused prepaid period and give you time to export your sketches.

11. Governing law and changes

These Terms are governed by the laws of India. The courts at Mumbai, Maharashtra have jurisdiction over disputes, except that nothing in these Terms removes consumer protection rights you have under the laws of the country where you live.

We may update these Terms. For material changes we will update the date above and tell account holders by email or in the app before the change takes effect.
